Agreement to terms
These Terms of Use are an agreement between you and Red Lion Pharmacy ("we," "us," or "our") concerning your use of the redlionrx.com website (the "Site"). By accessing the Site, you agree to be bound by these terms. If you do not agree with all of these terms, do not use the Site.
The Site is intended for users who are at least 18 years old, and for caregivers acting on behalf of someone in their care. The information on the Site is intended for use in the United States.
This website is not medical advice
Content on this Site is general information about our pharmacy and its services. It is not medical advice, and it does not create a pharmacist–patient relationship. Always follow the directions on your prescription label and the counseling you receive from your pharmacist and prescriber.
If you have a medical emergency, call 911 immediately. Do not use this website for urgent medical needs.
Requests made through this site
Submitting a refill, transfer, or contact request through this Site is a request only. It is not a guarantee that a prescription will be filled, transferred, or covered by your insurance. Our pharmacy team reviews every request and will contact you.
Intellectual property rights
Unless otherwise indicated, the Site is our property, and all source code, designs, text, graphics, and logos on the Site are owned or controlled by us or licensed to us, and are protected by copyright, trademark, and other intellectual-property laws. You are granted a limited license to access the Site and to download or print content for your personal, non-commercial use. No part of the Site may be copied, republished, or exploited for any commercial purpose without our express prior written permission, except as permitted by law (for example, fair use or citation).
User representations
By using the Site, you represent and warrant that:
- Any information you submit through the Site is true, accurate, and complete, and concerns yourself or a person you have authority to act for;
- You have the legal capacity to agree to these terms;
- You will not use the Site for any illegal or unauthorized purpose; and
- Your use of the Site will not violate any applicable law.
Prohibited activities
You may not access or use the Site for any purpose other than the ones we make it available for. As a user of the Site, you agree not to:
- Submit information about another person without authority to act for them;
- Trick, defraud, or mislead us, including any attempt to obtain another person's health information;
- Circumvent, disable, or interfere with security-related features of the Site;
- Attempt to probe, disrupt, or gain unauthorized access to the Site or its infrastructure, or interfere with its operation;
- Upload or transmit viruses or other malicious material;
- Use automated tools to submit forms on another person's behalf; requests must be reviewed and submitted by a human;
- Systematically extract data from the Site to build a competing collection or service; or
- Use the Site in a manner inconsistent with applicable laws or regulations.
Submissions
Questions, comments, suggestions, or other feedback about the Site that you send us may be used by us for any lawful purpose without compensation to you. This section does not apply to health information or service requests, which are handled under our HIPAA Privacy Notice.
Third-party websites and content
The Site may contain links to third-party websites. We do not monitor or check third-party websites for accuracy or completeness, and we are not responsible for their content, privacy practices, or policies. Inclusion of a link does not imply our endorsement. If you leave the Site through a link, these terms no longer govern. Review the destination's own terms and policies.
Site management
We reserve the right, but not the obligation, to monitor the Site for violations of these terms, to take appropriate legal action against violators, to restrict access to the Site, and otherwise to manage the Site to protect our rights and property and its proper functioning.
Privacy policy
We care about data privacy and security. Please review our Privacy Policy, which is incorporated into these terms, and our HIPAA Privacy Notice for health information. The Site is hosted in the United States; by continuing to use it from elsewhere, you consent to your data being transferred to and processed in the United States.
Modifications and interruptions
We may change, update, or remove Site content at any time without notice, and we may modify or discontinue all or part of the Site. We cannot guarantee the Site will be available at all times. Maintenance and technical problems may cause interruptions. We are not liable for any loss caused by your inability to use the Site during downtime. The pharmacy remains reachable by phone whether or not the Site is available.
Governing law
These terms and your use of the Site are governed by the laws of the State of Maryland, without regard to conflict-of-law principles.
Dispute resolution
Informal negotiations
To expedite resolution and control the cost of any dispute related to these terms (a "Dispute"), you and we agree to first attempt to negotiate any Dispute (except those expressly excluded below) informally for at least thirty (30) days before initiating arbitration. Informal negotiations begin upon written notice from one party to the other.
Binding arbitration
If we cannot resolve a Dispute through informal negotiations, the Dispute (except those expressly excluded below) will be finally and exclusively resolved through binding arbitration. YOU UNDERSTAND THAT WITHOUT THIS PROVISION, YOU WOULD HAVE THE RIGHT TO SUE IN COURT AND HAVE A JURY TRIAL. The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association ("AAA") and, where appropriate, the AAA's Supplementary Procedures for Consumer Related Disputes, available at www.adr.org. The arbitration may be conducted in person, through the submission of documents, by phone, or online. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in Baltimore County, Maryland. If for any reason a Dispute proceeds in court rather than arbitration, it shall be commenced in the state and federal courts located in Maryland, and the parties consent to personal jurisdiction and venue there. In no event shall any Dispute be commenced more than one (1) year after the cause of action arose.
Restrictions
Any arbitration shall be limited to the Dispute between you and us individually. To the full extent permitted by law: (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class-action procedures; and (c) no Dispute may be brought in a purported representative capacity on behalf of the general public or any other persons.
Exceptions
The informal-negotiation and arbitration provisions above do not apply to: (a) Disputes seeking to enforce or protect a party's intellectual-property rights; (b) Disputes arising from allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) claims for injunctive relief. Nothing in this section limits your rights under HIPAA or your ability to file a complaint with a government agency.
Corrections
The Site may contain typographical errors, inaccuracies, or omissions. We reserve the right to correct them and to change or update information at any time, without prior notice.
Disclaimer
THE SITE IS PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE OF IT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THIS DISCLAIMER CONCERNS THE WEBSITE ONLY. IT DOES NOT LIMIT OUR PROFESSIONAL OBLIGATIONS AS A LICENSED PHARMACY.
Limitations of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE. Nothing in these terms limits our professional obligations as a licensed pharmacy, or any right you have under applicable law that cannot be limited by agreement, including your rights under HIPAA.
Indemnification
You agree to defend, indemnify, and hold us harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these terms or your violation of the rights of a third party through your use of the Site.
Electronic communications
Visiting the Site and completing online forms constitute electronic communications. You consent to receive electronic communications related to your use of the Site, and you agree that agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing.
California users and residents
If a complaint with us is not satisfactorily resolved, you can contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, California 95834, or by telephone at (800) 952-5210.
Miscellaneous
These terms and the policies posted on the Site constitute the entire agreement between you and us regarding the Site. Our failure to enforce any provision is not a waiver of it. If any provision of these terms is found unlawful or unenforceable, it is severable, and the remaining provisions stay in effect. These terms do not create any joint venture, partnership, employment, or agency relationship between you and us.
